Navigating building policies: Sustainable Building SEPP updates

Embarking on a building development in NSW?

The landscape of sustainable building practices in NSW is evolving, particularly for non-residential developments. Explore the significant updates in the State Environmental Planning Policy (Sustainable Buildings) 2022, also known as the Sustainable Buildings SEPP, that are reshaping the way we build and design.

 

This policy has been in effect from 1 October 2023 and includes mandates to embodied carbon emissions reporting, net zero requirements, and enhanced energy and thermal performance standards as part of your planning approval process.

 

Which developments are affected?

  • Location: NSW
  • New builds with a Capital Investment Value (CIV) of $5m or more.
    Alterations and additions to existing builds with a CIV of $10m or more.
  • Exemptions: Rural, industrial, environmental conservation, and waterways zoning, along with infrastructure projects or those classified as Exempt and Complying Development.

 

3 must-know requirements for non-residential developments

  • Embodied carbon emissions reporting: Developers are now required to disclose the embodied carbon emissions of key materials during the development application and construction certification stages. Utilise the NABERS form for transparent reporting and to set clear carbon reduction strategies. This step ensures accountability and aligns your project with the latest sustainability standards.
  • Energy and water standards: Non-residential developments are now required to independently verify that your development meets NABERS energy and water performance requirements. Additionally, you’ll have to purchase offsets for necessary onsite fossil fuel use and to rectify any performance gap for energy efficiency.
  • Net zero statement: You will need to demonstrate your readiness by submitting a net zero statement that showcases how your building has the sufficient space and infrastructure to operate without fossil fuels by 2035.
